Are Melksham’s play areas safe?

THE safety of parks owned by Wiltshire Council in Melksham has come into question after it was disclosed that the parks have not been independently inspected for ‘several years’.

The parks in question are currently part of a deal between Wiltshire Council and Melksham Town Council that will see the town council take on a seven-year licence to manage them.

However the town council’s clerk, Linda Roberts, has expressed her concern that whilst checks may have been carried out by Wiltshire Council staff, annual checks by an independent organisation have not been carried out. 

At the town council’s asset management committee meeting, Linda said, “We’ve established that the play areas Wiltshire Council own have not been RoSPA (Royal Society for the Prevention of Accidents) inspected for several years, which concerns me as I thought it was an insurance requirement that an external organisation does a full report on safety, and the maintenance of the play equipment.

“We will continue to have Melksham’s inspected by RoSPA, but I think it would be prudent for the town council to get those that we are going to take from Wiltshire Council, RoSPA inspected.”

A member of staff at Melksham Town Council told Melksham News that the town council is arranging for all the play areas in question to be independently checked by RoSPA as soon as possible. 

The news affects the parks in Awdry Avenue, Dorset Crescent, Dunch Lane, Hazelwood Road (the play area and the multi-use games area), Primrose Drive, Riverside Drive, Speedwell Close (Campion Drive), Spring Meadow, Woody Park (Queensway). The town council also say that it is possible that the play area in King George V playing field (excluding the equipment installed by the town council in 2017 to replace the paddling pool) has also not been independently inspected.

A spokesperson from RoSPA who would normally carry out the safety inspections, told Melksham News, that whilst there are no specific Acts of Parliament that cover play areas, Wiltshire Council has a ‘duty of care’ to ensure that their play areas are safe – breaches of this ‘duty of care’ could be a criminal offence.

They said, “In legal terms, play provision is governed by the Health and Safety at Work etc. Act 1974 (in Northern Ireland the Health and Safety at Work (Northern Ireland) Order 1978) and the Occupiers’ Liability Acts 1957 and 1984 (in Scotland the Occupiers’ Liability Act (Scotland) 1960; in Northern Ireland the Occupiers’ Liability Act (Northern Ireland) 1957 and Occupiers’ Liability (Northern Ireland) Order 1987). 

“These Acts impose a duty of care on providers and occupiers. In the case of the Health and Safety at Work etc. Act, breaches of this duty of care are a criminal offence. By contrast, the Occupiers’ Liability Acts provide the legal basis for civil claims but not criminal convictions. In practice, both these pieces of legislation imply a similar level of care for providers, captured in the notion of ‘reasonableness’.

“Whilst there are no specific Acts of Parliament that cover play areas, both The Occupiers Liability Act (Revised 1984) and The Health and Safety at Work act (1974) impose a proactive “duty of care” where children are involved. In practice this means that you have to take special care where children are concerned, and this includes anticipating “reasonable misuse”. 

“In addition, the Management of Health and Safety at Work Regulations mean that you have a legal responsibility to have risk assessed the site and surroundings for risks to users. Large local authorities will usually have a sports and leisure department that will implement a play policy, this will include provision, installation, training, operation, inspection and maintenance of their play facilities. Inspection and maintenance may be in-house or contracted out. 

“Smaller authorities and local councils generally use an independent inspection service such as RoSPA Playsafety to undertake their inspections, training and risk assessments.”

Wiltshire Council was approached for comment, but had not responded by the time Melksham News went to print.

Learn CPR skills and how to save a life with a free demonstration by St John Ambulance volunteers at Gompels Pharmacy this Saturday.

The event, part of the nationwide annual Restart a Heart initiative, will run from 10am to 4pm on Saturday 11th October. The session is free and will equip people with CPR skills and teach them how to help someone who might be experiencing a cardiac arrest.

Restart a Heart Day aims to increase the number of people surviving out-of-hospital cardiac arrests by helping more people learn CPR. According to the Resuscitation Council UK, 80% of cardiac arrests happen at home.

The demonstration will take place at Gompels Pharmacy’s 1 Bank Street branch in Melksham.

  • Local women celebrate diversity with new social group

A group providing a safe space for younger women to socialise and connect has launched in Melksham.

The Sundaze Club launched on Saturday 21st September at The Bear and aims to provide a friendly and welcoming space for women to meet others and be themselves. The group, created by two local women, Becky and Kadie, plans to meet once a month, with the possibility of meeting more frequently.

wanted to create a space where other neurodivergent women can feel accepted

“We sat down one day talking about how it’s surreal in this day and age that people can still get left out of social circles and made to feel different,” said Becky. “We want to change that really.”

  • Melksham cemetery could run out of space within six months

Melksham’s cemetery could run out of new burial space within six months, after Wiltshire Council was accused of withdrawing expansion plans. 

Local families may soon need to consider alternatives, such as cemeteries in nearby towns, as Melksham’s cemetery located on land along the A350 nears full capacity. It was previously expected to have space until 2027, but Wiltshire Council has recently revised its estimate to predict new burial plots could run out within six months. Space for ashes and Muslim burials is expected to last until around 2027.

Wiltshire Councillor Phil Alford says the situation has been made worse by what he describes as a sudden reversal of earlier assurances about cemetery provision.

He said, “In June 2024 we were told that there was a strip of land for an expansion and we had until June 2027 to plan ahead. Now we have been told by the new Lib Dem administration that this has been withdrawn and in six months the cemetery will be closed to new burials.

  • Girls’ rugby thriving in Melksham as World Cup winners visit

Girls’ and women’s rugby is thriving in Melksham, with two England World Cup winners visiting the town on Sunday 5th October to see the success of the club’s growing girls’ section.

Hundreds of people turned out to Oakfield Stadium for a full day of rugby, where Red Roses Zoe Aldcroft and Alex Matthews met young players and fans before taking part in a Q&A session. The event also celebrated the first-ever match for Melksham’s new under-16s girls’ team, joining the existing under-12s and under-14s squads.

Zoe Aldcroft, who captained the England team to World Cup victory, said it was special to see how much the game is growing locally. 

“It’s so important to keep the momentum going from the World Cup,” she said. “To come down here to Melksham and see so many young girls picking up a rugby ball is really special. We’ve heard there have been so many new enquiries recently, which just shows how much interest there is – it’s great to see so many inspired to get involved.”

  • Wiltshire Council urges residents to use licensed waste collectors following fly-tipping fine in Melksham

Wiltshire Council is reminding residents to dispose of their waste responsibly and only use licensed waste carriers, following a recent fly-tipping incident in Melksham that resulted in a £600 fixed penalty notice (FPN).

The council’s Stop at Source (SAS) campaign continues to reduce fly-tipping across the county by holding householders accountable for their duty of care when disposing of waste. The zero-tolerance approach ensures that residents understand the risks of using unlicensed collectors.

In the recent case, a Melksham resident paid £10 to a passing tipper van to remove waste after placing non-recyclable items in the wrong bin. The waste was later found dumped in a hedge less than half a mile away. As the resident was unable to provide the waste carrier’s licence number, vehicle registration, or a receipt, they were held liable and issued a fine.

  • Local massage therapy company shortlisted in UK Small Business Awards

A massage therapy company in Shaw has been shortlisted in the UK Small Business Awards.

Hilot Massage Therapy, based on Bath Road in Shaw, has been trading for three years and offers a mixture of holistic and sports therapies.

Owner Cherlina Ogilvie-Robb initially set up Hilot Massage Therapy in her spare room in Shaw. The business grew so quickly that within six months she moved into a purpose-built garden room.

Since then, she has never looked back and now has hundreds of clients on her books, including a Bath Rugby first team player, an ex-Commonwealth swimmer, a bodybuilder and marathon runners.

Due to the business’s continued growth, Cherlina plans to move to new premises in the next couple of months. This will allow her to further expand her offering to include couples’ massages and ladies’ nights.

Beltane: The Robinson Crusoe School (part 1)
Deeper dives into historic backgrounds are often inspired by casual questions.

These trigger a closer look that often reveal amazing stories. A few years ago, I was asked if I had information about Beltane from a former student. He was asking if there were other students he could be in touch with. Scratching the surface and making public inquiries lead to nothing more than an apology in response.

Not only were there no takers, but the local history of Beltane seemed buried, which left more questions than answers. I basically knew that it was opened in Shaw Hill House in 1939 and closed in 1952 when the junior department transferred to High Canons, near Barnet, Hertfordshire. The senior department had moved there two years prior.

  • Flower and produce show celebrates Melksham’s gardening community

This year’s Melksham Gardeners’ Society Flower and Produce Show has been hailed a success, as the town’s keen gardeners were awarded for their efforts.

The show was held on Sunday 7th September at the Assembly Hall and despite the long hot summer, the benches were full of flowers, fruit and vegetables, with classes in handicrafts, preserves, baking and the ever-popular photography sections being very well supported.

“Not forgetting the young exhibitor’s section had some beautiful entries,” said Mike Goodhew, secretary for the Melksham Gardeners’ Society.

“A new addition to the show this year was the Visitors Choice award for the public to vote on their favourite picture in the photography classes.

  • South West’s largest camera and photographic fair

Frome will once again play host to the South West’s largest celebration of all things photographic when the Frome Wessex Camera & Photographic Fair returns to the Cheese and Grain on Sunday 19th October.

More than 30 specialist stalls will fill the venue, offering everything from modern digital gear to collectable vintage cameras, alongside lenses, filters, flashguns, film, books and old prints. For anyone with a passion for photography – whether seasoned professionals, collectors, or those just picking up a camera for the first time – the fair promises a real treasure trove.

“If you’ve never been to a photographic camera fair, you’re missing a treat,” said David Chedgy from the Frome Wessex Photographic Club.

“The prices are low, and you’ll find cameras, lenses and lots of other photographic accessories.

“Camera fairs are very friendly places and the stallholders will be pleased to give help and technical assistance on cameras and photographic equipment.”
