Whitley neighbours call for change to planning law

A GROUP of Whitley neighbours are calling for a change to planning law to prevent developers from applying to build on land that they do not own. 

The neighbours, who live on Brookfield Rise in Whitley, have banded together in response to a planning application to build two new houses on land to the rear of Eden Grove. The application requires using land privately-owned by one of the Brookfield Rise residents for access to the new homes.

The Brookfield Rise residents say that the application requires the demolition of  a wall owned by Ann Smith causing – and if approved by Wiltshire Council would force Ann Smith to take legal action to prevent the plans moving forward.

The trio have called into question how a planning application can be made by a person that does not own, or have any right to, all of the land involved. And they are calling for a change to planning law to prevent this from happening to others.

However, Wiltshire Council has stated that as long as the applicant notifies all landowners, it is permissible for a planning proposal to be submitted that includes land not owned by the applicant.

The council has explained that if planning permission was granted, the plans could not move forward until all of the landowners have agreed.

Speaking to Melksham News, the residents said, “Wiltshire Council has confirmed that they know the applicant does not own or have any right to access his neighbours’ land but could grant permission any way. 

“Thus knowingly forcing Mrs Smith, an elderly vulnerable pensioner, into taking legal action to prevent the applicant unlawfully gaining access to her property. 

“Why do the planning department even consider granting planning permission when they have been told the applicant does not own all the land?

“Something needs to change as many people are losing their property because of this flaw in the planning procedure. Not everyone is aware that a planning application can be taken out in this way. 

“It’s causing heartache and expense unnecessarily for someone else’s greed. Pensioners are stressed enough at the moment with Covid-19, why should they have to incur more stress and spend money they don’t have, to keep what they have worked all their lives for?”

In response to the concerns, cllr Toby Sturgis, Wiltshire Council cabinet member for planning, told Melksham News, “We have been in contact with the resident and applicant regarding this planning application, and can confirm that in his submission, the applicant has made it clear that they don’t own all of the land on the application site.

“However, it is permissible to submit a proposal for planning permission that includes land not owned by the applicant, provided that the applicant notifies those landowners of the submission of the application so that they are properly informed. This requirement has been met in this application.

“We cannot take ownership issues into account when deciding an application, as that would be a private matter to be resolved between the parties, but any planning permission, if granted, could only be implemented with the agreement of the landowners.”

The applicant was contacted for comment.

The next films to be shown at the Melksham Monday Movies Club will be The Best of Men and Six Minutes to Midnight.

On 2nd February, The Best of Men will be shown, and is based on real events. In 1943, a refugee doctor from Nazi Germany uses new methods to rehabilitate those with spinal injuries in Great Britain. The film stars Rob Brydon, George Mackay, Bebe Sanders and Leigh Quinn.

On 16th February, Six Minutes to Midnight will be screened. In the UK, on 15th August 1939, 17 days before World War Two, an English teacher and his camera disappear from a coastal boarding school with 20 German teen girls. Miller gets the job six days later, secretly trying to find out what happened. The film stars Eddie Izzard, Judi Dench and Nigel Lindsay.

Both films will be screened at the Assembly Hall. Doors open at 1.30pm, with the film starting at 2pm.

There will be a break for tea or coffee and a chance to catch up with friends before the event finishes around 4pm. Admission is by donation, with a suggested amount of £5.

  • Melksham Without raises precept by 6.1% in new budget

Melksham Without Parish Council has agreed to raise its precept, the parish council’s share of council tax, by 6.1% for the 2026/27 financial year.

Parish councillors unanimously agreed to the rise at the Full Council meeting held on Monday 26th January, where they also set their budget for the year at £302,429.

This means that an average Band D property will contribute £101.14 to Melksham Without Parish Council, a £5.49 (5.74%) rise on last year. This will be a rise of 11p per week for the average parish household. 

Clerk of Melksham Without Parish Council Teresa Strange said, “The parish council have strived to keep the cost low for residents, whilst maintaining services and investing in assets.

“The parish council runs a number of facilities and services in the parish from this precept funding and supports a number of community ventures in both the parish as well as those in the town and villages outside the parish."

  • Back-to-back defeats leave Town in relegation trouble

Melksham Town’s poor start to 2026 has continued with two defeats, making it four defeats in a row now since the start of the New Year.

The defeats leave Town just one point above the relegation zone, having played more games than the teams below them.

On Saturday 17th January, Town went down to a dramatic 5-4 defeat at home to Shaftesbury. Twice Melksham went behind in the first-half but hit back immediately. First, Shaftesbury opened the scoring on 20 minutes only for Will Christopher to equalise two minutes later; then on 43 minutes, the visitors struck again, but Town equalised within a minute through Olly Mehew. 

Melksham took the lead straight after the break; Jamal Lawrence with his 13th of the season before Shaftesbury levelled on 49th minutes.

  • Public consultation on future of town’s park

Residents are invited to share ideas for the future of King George V Park at a public consultation on Saturday 7th February.

The consultation will take place in the park after parkrun, where Melksham Town councillors will be available to discuss ideas for the space, events residents enjoy and what they would like to see more of.

“The King George V Park is our premier park in Melksham, it is a fabulous park but it is time to move things forward,” said Cllr Adrienne Westbrook.

Ideas shared will help shape an updated masterplan, setting out a long-term strategy for the park. Councillors are particularly keen to discuss the sensory garden and its location, the future of the dog park and how to improve the park’s entrances.

“At the moment we have two entrances but without any signs or history of why the park is called King George V Park,” said Cllr Westbrook.

  • Melksham resident celebrates 100th birthday

A Melksham resident has celebrated his 100th birthday this month.

Ron Francis turned 100 on Wednesday 21st January and said he was ‘astonished’ to reach the milestone and receive a birthday card from King Charles III.

“I was very pleased to receive this, it’s just lovely,” said Ron, who has lived in Melksham for 30 years with his wife, Janet Francis.

During his 100 years, Ron fought in World War II as part of the Royal Air Force Association. He later recalled fond memories of working at Collins, the publishers in Pall Mall, where he met Agatha Christie.

“She was very nice person. She never talked down to you,” said Ron. “I used to make her a cup of tea and she always insisted on giving me some money, which I didn’t need. She always insisted on paying me something for the tea. She was a really lovely lady.”

  • Teen bowler wins two silver medals for England

A Melksham teenager has won two silver medals representing England at a recent international indoor bowls tournament.

Alfie Holland, 17, travelled to Scotland to compete in the International Under 18s Indoor Bowls Series, which took place from 9th to 11th January. He competed against some of the best young bowlers from across the home nations.

Alfie plays outdoor bowls at the Avon Bowls Club, by Melksham Community Campus, and indoor bowls at North Wilts in Chippenham.

Alfie said, “I feel honoured and proud to have been selected for England over the past three years and to win two silver medals in my last year in the Under 18s was amazing.

“It has been a fantastic three years. The team management and squad members are all a fantastic bunch of people. Those that have supported me and messaged me from both Avon Bowls Club and North Wiltshire Indoor Bowls Club, thank you. It means a lot.”

  • Melksham Townswomen’s Guild closes after 70 years

An organisation that has brought women together in Melksham for seven decades has closed after declining membership.

The Melksham Townswomen’s Guild held its final meeting in January after struggling to recruit new members. The group, which began in 1955, offered local women the chance to meet, take part in social activities and listen to guest speakers.

The national Townswomen’s Guild movement was founded in 1929, emerging from the Suffragette movement and aiming to promote women’s education and participation in public life. Guilds have traditionally offered women a chance to come together to discuss issues, campaign on matters affecting their lives and take part in community activities.

Chairperson Tricia Hoy said the Melksham branch’s membership had fallen to around 10 or 11 members, making it unsustainable to continue.
